CONDITIONS OF BOOKING AN ALPHA SHOW
- A specific date and time cannot be guaranteed, even with a deposit. The deposit secures a place in our schedule, but the booking remains floating until we agree on a mutually acceptable date. We will work with you to find the best time.
- A booking deposit of $400 applies at time of booking to reserve your place in our schedule, this does not confirm other details such as audience size, which you will confirm on show day. Alpha does not take bookings without a deposit. Failure to pay your deposit within time specified on the booking confirmation statement will result in either: removal from the schedule (if necessary), date changes without notice, or the loss of your discount/loyalty rates resulting in your booking defaulting to our standard full rate. Final payment is due within 7 days of the PERFORMANCE. You agree to send your final audience numbers on performance day or shortly after. You can use the Alpha Shows App to conveniently and easily update your audience numbers. You agree to make the final payment of your show fee via direct deposit or credit card within 7 days. A $50 late payment fee will apply for payments not received within this period.
- The booking deposit is non-refundable under any circumstances, unless we cancel your show at our discretion. If you choose to permanently cancel for any reason, including changes to your schedule, policies, or due to force majeure (conflict, lockdown, government restrictions, or natural disasters), the deposit will not be refunded.
- An additional cancellation fee of $800 (per performance) applies to all cancellations made within 11 days of the show, including canceling one out of two performances. If you’ve paid a deposit and wish to reschedule, your booking deposit can be transferred to the new date. All cancellation or reschedule requests must be made in writing (email is fine).
- You can reschedule without any fee 11 or more days before the original date, including to the following year. Rescheduling within 11 days forfeits your booking deposit and any other costs incurred by Alpha, such as accommodation, fuel, and actor stand-down fees according to MEAA award regulations. If reducing from 2 performances to 1, notice must be given 11 or more days in advance. Rescheduling is free as long as there are no additional costs to Alpha.
- Any extra costs associated with the performance will be at your school’s expense. If Alpha covers any costs due to your policy, your school will lose eligibility for discounts and may incur an additional administration fee of $200 or equivalent. Alpha will not be liable for any damage, repair, or cleaning of the venue or property, including normal wear and tear like gouges, scratches, tyre marks, or bogging. You agree to inform any third-party venue of these conditions. The venue/client assumes responsibility for audience safety, including anyone going on stage, and confirms appropriate insurance is in place. Any damage to Alpha’s equipment or vehicles not caused by Alpha staff will be charged to your venue/school.
- By permitting the show to go ahead, your school automatically agrees to these conditions. All bookings must be accompanied by a signature agreeing to these conditions. You can take care of this requirement in advance on the Alpha Shows App. If we do not receive an agreement to these conditions and a signature beforehand or onsite, we may need to cancel the show and/or leave your venue without a refund.
- Alpha is a Child Safe Standards Organisation, and our policy can be found here: https://www.alphashows.com.au/child-safe-standards/. All Alpha staff hold or have applied for their Victorian Working With Children Check (WWCC) as required by the Working With Children Act (2005). It is Alpha’s responsibility to ensure staff have a valid WWCC, not the school’s. You can access copies of our staff’s WWCC through the Alpha Shows App and use them for your official visitor record.
- For the avoidance of doubt, Alpha will not be required to obtain, and cannot be compelled to obtain, Blue Cards or equivalent checks issued by other states or territories. Schools and venues agree that Victorian WWCC is the sole clearance required.
- Any additional compliance requirements imposed by a school or venue (including but not limited to sign-ins, inductions, online modules, or background check procedures) must not exceed 5 minutes in total. Where additional time or administrative burden is required, Alpha reserves the right to charge the school or venue at the applicable rate, consistent with our clause on extra costs.
- Ground floor access to an indoor venue is required from arrival to departure for unloading and loading of substantial equipment. Outdoor venues are not permitted. If the Alpha van cannot get within 10 meters of the venue, an additional $175 will be charged to cover extra time and effort for bump-in. The van requires 3m height clearance, 2.5m width, and a large turning circle with cleared space (no other vehicles/equipment). The venue must be on the ground floor, or if not, a lift must be available, with the bump-in fee applying. We require continuous access for the entire visit and cannot move our vehicle after load-in due to safety and time constraints. Any delays in unloading/loading will incur an additional cost of $25 per 10 minutes or part thereof. We require access to an unlocked, child-free, and open venue up to 20 minutes before the official arrival time. Delays will result in a delay to the show start time.
- You agree not to charge students or take money from a levy beyond the charge per student listed on your invoice. Any fundraising must be approved by Alpha for a worthy cause. Students can pay up to the last minute, including cash to an Alpha staff member on the day, but should not be included in the final audience tally. No student should be turned away for late payment; they are encouraged to “buy a ticket” and pay on the day.
- If the teacher-in-charge-of-bookings changes for any reason (e.g., teacher leaving, absence, role change), please notify us promptly with the new contact’s name and email address. The contact must be someone who will attend the performance and be available to communicate with our team. You can update your contact through the Alpha Shows App.
OTHER CONTRACTUAL TERMS:
- You are responsible for all promotion of the show or venue hire for the event. The title must be represented as “The Alpha Show of [SHOW]” or, if within text, “Alpha’s [SHOW]”—but never as the main title. The use of “pantomime” or “panto” is prohibited.
- The graphic provided by Alpha for the show title must be used prominently in all marketing materials, and should be large enough to read. No other versions or fonts are permitted.
- The Alpha logo must be included on all marketing materials and be legible.
- All artwork must be approved by Alpha Shows before printing or publishing.
- Only images provided by Alpha may be used in marketing materials—no Disney or other unrelated images. Adherence to copyright laws and product integrity is critical to avoid misleading the audience.
- Materials provided by Alpha, including coloring sheets, must not be altered or edited without permission.
Conditions of Use:
This website has been made available to you subject to your compliance with the terms and conditions set forth below (the “Conditions of Use”).
Access to and use of the Alpha Shows Pty Ltd website, the Alpha Shows App, our social media channels, live events, performances, and any related services (collectively, “Services”) is provided subject to the following Conditions of Use. Please read these conditions carefully before accessing or engaging with Alpha Shows.
By accessing our website, booking or hosting a show, using our App, interacting with our social media, or otherwise engaging with Alpha Shows, you agree to be bound by these Conditions of Use and all related terms and policies. If you do not agree to be bound by these Conditions, you must not access or use the website, our Services, or book a performance.
Modification of these Conditions of Use
Alpha Shows Pty Ltd reserves the right to amend these terms, conditions, and notices at any time. Any modifications take effect immediately upon being posted on the Alpha Shows website. Customers are responsible for reviewing the current Conditions of Use and the Conditions of Booking as published on our website. While copies may also appear on your Date Confirmation Statement, the website version always prevails and supersedes any earlier version. Continued use of our services constitutes acceptance of the current terms.
If you have acted in the past contrary to the current Conditions of Booking or Use, you are required to immediately take the necessary steps to ensure compliance. Importantly, if your own internal policies or departmental requirements change after a booking has been made or at any time, this does not and cannot alter or override Alpha Shows’ contractual Conditions of Booking. You cannot retroactively vary or terminate a contract on the basis of a policy change on your end.
The contractual terms and Conditions of Booking are set solely by Alpha Shows. Customers and clients do not have the authority to add, imply, or enforce additional terms not expressly agreed to in writing by Alpha Shows.
Alpha Shows’ Conditions of Booking form the entirety of the agreement between Alpha Shows and the customer. No additional terms, policies, or requirements of the customer or their governing body shall apply unless expressly agreed to in writing by Alpha Shows’ management. This includes, without limitation, state-based working with children checks, training modules, inductions, medical or vaccination requirements, insurance variations, additional compliance documentation, or extended onsite sign-in procedures. Any such requirements that Alpha elects to complete will be treated as additional services and charged to the customer at Alpha’s applicable rates.
Alpha Shows staff are required only to hold valid Victorian Working With Children Checks (WWCC), as expressly stated in our conditions, and this is the sole clearance applicable to our services.
By proceeding with a booking and/or by signing our Conditions of Booking during previous bookings and/or on the day of the show, which is required before we can begin setup in your venue, customers acknowledge and accept these terms in full. Any subsequent attempt to vary or avoid them is invalid and unenforceable.
Privacy
Other than standard internet data, Alpha Shows Pty Ltd does not collect or use any of your personal information unless specifically sent by you to an email address with a Alpha Shows Pty Ltd domain, or posted on the Alpha Shows App. If you do send your email or other personal details, then this will be used solely for communication and marketing with you, and your information will not be shared with outside parties.
Alpha Shows App Privacy Policy
The Alpha Shows App is designed to provide a safe and engaging experience for children, educators, and performers. To maintain a secure environment, all character and support chat interactions are monitored for moderation purposes. However, we do not retain chat logs, store personal conversations, or create permanent user accounts.
Users can delete their profile at any time within the app, which will remove all associated data from our system.
For operational purposes, certain user actions—such as downloading resources—may trigger notifications to our internal team via our secure communication platform. If you have provided a name or email in your profile, this information may be included in these notifications to allow us to offer support if needed. This data is never shared with third parties and is only used to enhance your experience within the app.
We are committed to protecting your privacy, and all information provided within the app is used solely to deliver its features and services. By using the Alpha Shows App, you agree to these privacy practices.
Electronic Communications
When you visit the Alpha Shows website or send communications to us, you are communicating with us electronically, and you consent to receive communications from us electronically or by other lawful means. We may communicate with you by email, telephone, facsimile, post, or any other contact information you have provided or that is otherwise publicly available or lawfully obtained by Alpha Shows (including from public directories, official school websites, or databases acquired in compliance with applicable laws).
You acknowledge and agree that by providing, publishing, or making available a school or work email address or other professional contact information, you consent to receive communications from external service providers such as Alpha Shows to those addresses.
All agreements, notices, disclosures, invoices, and other communications that we provide to you electronically are deemed to satisfy any legal requirement that such communications be in writing. You further agree that any communication sent to the email address or contact details you have provided, or that are publicly available for your role, will be considered validly delivered once transmitted by Alpha Shows.
Copyright and Licenses
The entire contents of this website, including but not limited to: Text, graphics, logos, button icons, scripts, designs, show concepts, values education themes and messages, Flash movies, images, audio clips, video, digital downloads, data compilations, and software, are the property of Alpha Shows Pty Ltd, its content suppliers or it’s clients and are protected by Domestic and International copyright and trademark laws. You are only permitted to view this content within the intended confines of the Alpha Shows website; you are not permitted to download any portion of this website to your own computer for later retrieval, unless the content is marked specifically as a ‘download’. You may also not modify, copy, reproduce, republish, upload, post, transmit, or distribute any portion of the website contents without the prior express written consent of Alpha Shows Pty Ltd. Any content that you are permitted to download (ie. it is marked or suggested you can download it) you must not alter it in any way and can only use it for its intended use for Teaching purposes, or the purposes of Marketing a show you have purchased from Alpha Shows Pty Ltd. License and Website Access
Alpha Shows Pty Ltd grants you limited license to access and make personal use of this website and not to download (other than for page caching purposes) or modify it, or any portion of it, except with the express written consent of Alpha Shows Pty Ltd. You are permitted to create one (1) account on this website per individual or organisation (not a personal AND professional accounts that are attached to separate emails); you must only access the website account functions under a single account for all activities and multiple personal, commercial, fake or spam accounts are prohibited.
